1. Introduction and Acceptance
These Terms of Service (the "Terms") govern your access to and use of the Pebbles website, mobile application, web application, content library, AI-powered features and assistants including Ami, child and family profiles, trackers, booking tools, payment flows, and any related products or services made available by Pebbles (collectively, the "Services").
These Terms form a legally binding agreement between you and the Pebbles entity identified in the applicable app, website, or legal notice ("Pebbles", "we", "us", or "our"). By creating an account, clicking to accept, accessing, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy, AI & Health Disclaimer, and any additional terms presented for a specific feature, provider, offer, or booking flow.
If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility and Permitted Users
You may use the Services only if you have legal capacity to enter into a binding agreement under applicable law. Unless Pebbles expressly states otherwise, the Services are intended for adults such as parents, expectant parents, guardians, caregivers, or other authorized users acting lawfully in relation to themselves or a child.
If you provide information about a child or another person through the Services, you represent and warrant that you are legally authorized to do so and that you have obtained any consent required by applicable law. Pebbles may request verification or additional information where reasonably necessary.
3. Account Registration and Security
To use certain features, you may need to create an account using an email address, phone number, Apple ID, Facebook account, or another supported sign-in method. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur through your account. You must promptly notify Pebbles if you suspect unauthorized access, misuse, or a security incident involving your account.
Pebbles may refuse registration, require identity or account verification, suspend access, or disable an account if we reasonably believe there is fraud, misuse, unlawful activity, or a breach of these Terms.
4. Description of the Services
The Services may include, without limitation: account creation and onboarding; parent, caregiver, pregnancy, and child profile features; personalization preferences; parenting profile or spiderweb assessments; developmental milestone, growth, and vaccination tracking tools; the Wisdom Hub content library; the Ami AI assistant and related automated features; service discovery and booking features; payment-related flows; notifications; and customer support.
The Services are designed to support learning, organization, personalization, decision support, and access to relevant services. Features may change over time, may not be available in all jurisdictions, and may be provided directly by Pebbles, by third-party providers, or by a combination of both.
5. Your Information, Inputs, and Personalization
You may choose, or may be required, to provide certain information in order to create an account, use the Services, receive personalized content, save records, make bookings, or complete payments. This may include, depending on the feature, information about you, your family, your child, your preferences, your usage patterns, and other information you submit through forms, trackers, chats, or booking flows.
You are responsible for the accuracy, legality, and appropriateness of the information you submit. Pebbles may rely on the information you provide in order to personalize the Services, generate reminders or outputs, recommend content or providers, and operate the Services.
Where the Services allow you to save records, notes, tracker entries, assessments, prompts, or booking details, you acknowledge that Pebbles may process and store those inputs in accordance with the Privacy Policy in order to provide the feature, improve usability and safety, support customer service, maintain records, prevent abuse, and comply with law.
6. Ami AI and Automated Features
Pebbles may offer AI-powered or automated features, including Ami, for informational, educational, organizational, and personalization purposes. AI-generated responses, reminders, classifications, summaries, and recommendations may be incomplete, inaccurate, outdated, generalized, or unsuitable for your circumstances.
You remain solely responsible for reviewing and evaluating any output before relying on it. You must not use Pebbles or Ami as a substitute for medical, mental health, legal, financial, childcare, or other professional advice or emergency assistance.
As between you and Pebbles, you retain any rights you may have in the information, prompts, and materials you submit to the AI features ("Input"), and subject to applicable law and these Terms, Pebbles grants you a limited right to use the resulting output generated for you through the Services ("Output") for your personal, non-commercial use in connection with the Services. Pebbles may use Input and related interaction data to operate, maintain, secure, review, troubleshoot, personalize, and improve the Services, as described in the Privacy Policy and applicable notices. Output may not be unique, and similar or identical output may be generated for other users.
Pebbles may impose usage limits, safety restrictions, moderation, human review, or feature-specific rules on AI features at any time.
7. Wisdom Hub and Informational Content
The Wisdom Hub and other content made available through the Services are provided for general informational and educational purposes only. Content may include articles, tips, summaries, checklists, recommendations, stage-based guidance, developmental information, and related materials.
Pebbles does not guarantee that any content is complete, error-free, current, or suitable for your or your child's specific circumstances. Content made available through the Services is not a substitute for professional advice, diagnosis, treatment, therapy, legal advice, financial advice, or any other regulated or licensed service.
You are responsible for how you interpret and use content from the Services. If you have concerns about pregnancy, postpartum recovery, infant or child health, development, vaccination, sleep, feeding, safety, or any other professional matter, you should consult an appropriately qualified professional.
8. Child Profiles, Trackers, and Records
The Services may allow you to create child profiles or related family records and to use milestone, growth, vaccination, or other trackers. These tools are intended to help you organize information, reflect on patterns, and access educational resources or relevant services.
Unless Pebbles expressly states otherwise in writing, these tools do not diagnose, prevent, monitor, or treat any disease or condition, do not replace professional assessment, and do not guarantee any outcome, classification, schedule, or interpretation.
You understand that the usefulness of these tools depends on the information entered by you, measurement quality, timing, context, and other factors outside Pebbles' control. You are solely responsible for verifying important information and for seeking professional guidance where appropriate.
9. Booking Features and Third-Party Providers
The Services may enable you to discover, compare, contact, schedule, purchase, or otherwise interact with service providers, merchants, clinics, coaches, therapists, educators, caregivers, or other third parties (collectively, "Providers"). Unless Pebbles expressly states otherwise for a specific service, Pebbles acts as a technology platform that facilitates discovery, booking, communication, and related transactions between users and Providers.
Pebbles is not the employer, principal, agent, representative, or insurer of independent Providers, and Pebbles is not responsible for the acts, omissions, advice, treatment, care, products, services, availability, qualifications, licenses, schedules, or conduct of any Provider. Any professional or service relationship formed through a booking is between you and the relevant Provider, subject to the Provider's own terms, policies, licenses, and legal obligations.
Providers may require you to agree to additional terms, consent forms, cancellation rules, privacy notices, intake forms, or service-specific policies before the service is delivered. Pebbles is not a party to those separate agreements unless Pebbles expressly states otherwise.
10. Fees, Payments, Cancellations, and Refunds
Certain features of the Services may be offered free of charge, while others may require payment, subscription, deposits, pre-authorization, or other charges. Applicable fees, taxes, payment terms, cancellation terms, and refund rules, if any, will be shown in the relevant part of the Services or in an applicable policy before you confirm the transaction.
By submitting a payment method, you authorize Pebbles and its payment processors to charge the applicable amounts, including deposits, booking fees, cancellation fees, no-show fees, taxes, and other disclosed charges, in accordance with the transaction details and applicable policies.
Refund timing, reversals, or release of pre-authorized amounts may depend on the relevant Provider, payment partner, issuing bank, card network, or wallet provider. Pebbles may issue service credits, vouchers, or alternative remedies where appropriate, subject to applicable policies and law.
11. Acceptable Use and Prohibited Conduct
You agree to use the Services lawfully, responsibly, and only for their intended purposes. You must not: (a) provide false, misleading, or unauthorized information; (b) infringe another person's rights or privacy; (c) upload malware, harmful code, or interfere with the integrity or security of the Services; (d) attempt to reverse engineer, scrape, harvest, or gain unauthorized access to the Services or related systems; (e) use the Services to harass, threaten, abuse, exploit, or endanger any person; (f) use the Services to generate, distribute, or rely on content for unlawful, deceptive, dangerous, or professional decision-making purposes in violation of these Terms; or (g) misuse promotions, credits, referrals, or support channels.
Pebbles may investigate suspected violations and may remove content, cancel transactions, limit functionality, suspend or terminate access, notify affected parties, or take other action permitted by law.
12. Intellectual Property and Limited License
The Services, including software, design, branding, text, graphics, interfaces, databases, arrangement of content, and other materials made available by Pebbles, are owned by Pebbles or its licensors and are protected by intellectual property and other applicable laws.
Subject to your compliance with these Terms, Pebbles grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use. Except as expressly permitted by law or in writing by Pebbles, you may not copy, modify, distribute, sell, lease, sublicense, publish, display, create derivative works from, or exploit any part of the Services.
13. Feedback
If you provide suggestions, ideas, comments, bug reports, or other feedback regarding the Services, Pebbles may use that feedback without restriction or compensation to you, to the extent permitted by law.
14. Privacy and Data Processing
Your use of the Services is also governed by the Pebbles Privacy Policy and any specific notices, disclosures, or consent flows presented at the point of data collection or feature use. By using the Services, you acknowledge that Pebbles may collect, use, store, analyze, transfer, and otherwise process personal data in accordance with applicable law and the Privacy Policy.
You are responsible for ensuring that any personal data you provide about another person, including a child, is lawfully provided and that you have all required rights, notices, and consents.
15. Service Availability, Changes, and Beta Features
Pebbles may add, remove, suspend, replace, or modify any feature, content, Provider listing, workflow, or technical requirement at any time. Pebbles does not guarantee that the Services or any part of them will always be available, uninterrupted, secure, or error-free.
Some features may be labeled as beta, pilot, experimental, early access, or similar. Such features may have limited functionality, may change frequently, and may be discontinued at any time.
16. Suspension and Termination
You may stop using the Services at any time. Pebbles may suspend, restrict, or terminate your access to all or part of the Services, with or without notice, if Pebbles reasonably determines that: (a) you breached these Terms or applicable law; (b) your use poses a risk to Pebbles, other users, Providers, or third parties; (c) information provided by you is false, unauthorized, or materially misleading; (d) Pebbles is required to do so by law or a competent authority; or (e) the relevant feature or Service is discontinued.
Termination or suspension does not relieve you of any payment obligation, legal responsibility, or other accrued obligation arising before termination.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PEBBLES DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUALITY, AVAILABILITY, RELIABILITY, ACCURACY, OR THAT THE SERVICES WILL MEET YOUR NEEDS OR EXPECTATIONS.
Without limiting the foregoing, Pebbles does not warrant that: (a) the Services will be uninterrupted, secure, timely, or error-free; (b) any AI-generated or automated output will be accurate, complete, or appropriate; (c) any article, guide, reminder, tracker result, or classification will be suitable for your circumstances; (d) any Provider will be available, qualified, safe, or satisfactory; or (e) any booking, payment, or communication will always be completed successfully.
The Pebbles AI & Health Disclaimer forms an integral part of these Terms.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEBBLES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEBBLES' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PEBBLES THROUGH THE SERVICES IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) THE MINIMUM AMOUNT REQUIRED UNDER APPLICABLE LAW.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
19. Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pebbles and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your Input, data, or information; (c) your breach of these Terms; (d) your violation of law or the rights of any person; or (e) disputes between you and a Provider or another third party.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Socialist Republic of Vietnam, unless mandatory law requires otherwise. Any dispute arising out of or relating to these Terms or the Services should first be discussed in good faith. If the dispute cannot be resolved amicably, it shall be submitted to the competent court in Vietnam, unless applicable law requires a different forum.
Nothing in this section prevents Pebbles from seeking injunctive or equitable relief from a competent authority where necessary to protect the Services, intellectual property, confidential information, personal data, or user safety.
21. Changes to These Terms and Contact Information
Pebbles may update these Terms from time to time. Unless applicable law requires otherwise, updated Terms will become effective when posted or when otherwise communicated through the Services. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the affected Services and, where applicable, close your account.
